Terms of Service
Last updated October 15, 2026
These terms are the agreement between you and Hello Spark LLC for using SparkBot. Please read them, along with our Privacy Policy, which explains how we handle your information.
1. Agreeing to these terms
SparkBot is the SparkBot website, web app and Chrome extension, operated by Hello Spark LLC ("we", "us"). By creating an account or using SparkBot, you agree to these terms. If you use SparkBot for an organization, you agree to them on its behalf and confirm you're authorized to do so.
2. Your account
You must be at least 18, or the age of majority where you live, to use SparkBot. Give accurate information when you sign up, keep your sign-in details secure, and tell us promptly if you think someone else has used your account. You're responsible for what happens under your account. An account is for one person.
3. What SparkBot does, and its limits
SparkBot lets you train assistants ("SparkBots") that answer questions about web pages and PDFs, and run them on the pages you open. Answers are produced automatically and quote the part of the page they came from, but they can still be incomplete or wrong, and they're only as good as the page they read.
SparkBot is not professional advice. Check anything important against the source, and get qualified advice before relying on an answer or a score for a financial, legal, medical, safety or other significant decision.
4. Your content
"Your content" means the pages you run SparkBots on or train them with, the SparkBots you create, and anything else you give us. You keep all rights in it. You give us a limited license to host, copy, process and display your content only as needed to provide SparkBot to you and the people you share with, as described in our Privacy Policy. We don't use your content to train AI models.
You're responsible for your content and for having the right to use SparkBot on the pages you open. Follow the terms of the sites you use it on, and don't use it on information you're not allowed to access or process this way.
5. Sharing and the Gallery
You can share a SparkBot with specific people or publish it to the Gallery. Sharing or publishing shares the SparkBot's instructions, never your pages or runs. When you publish a SparkBot, you let other SparkBot users run it, copy it, and adapt their copies for their own use. Making it private again stops new use, but copies others already made remain theirs. We may remove anything from the Gallery at our discretion.
6. Acceptable use
You agree not to:
- break the law, or infringe or violate anyone's rights, including privacy and intellectual property rights;
- use SparkBot to harvest personal information, or to collect data at a scale or in a way the source site prohibits;
- publish SparkBots that are misleading, hateful, harassing or otherwise harmful;
- probe, scan or test the security of SparkBot, or get around its limits, plans or access controls;
- interfere with SparkBot, overload it, or access it by automated means other than the extension and web app we provide;
- copy, reverse engineer or resell SparkBot, or use it to build a competing product;
- help anyone else do any of these.
7. Plans and billing
SparkBot has a free plan and paid plans, with prices and page allowances shown on our pricing page. Paid plans are billed monthly in advance, in US dollars, through our payment processor, Stripe, and renew automatically each month until you cancel. Prices don't include taxes, which are added where required.
- Cancelling: cancel any time from Manage subscription. You keep your plan until the end of the period you've paid for, then move to the free plan. Your SparkBots stay yours.
- Changing plans: switching between paid plans is prorated.
- Refunds: payments are non-refundable, except where the law requires otherwise.
- Fair use: the Unlimited plan is subject to the fair-use limits shown on the pricing page, which keep SparkBot fast for everyone.
- Price changes: we'll tell you at least 30 days before a price change applies to your subscription, and you can cancel before it does.
If a payment fails, we may limit your account to the free plan until it's resolved.
8. Changes to SparkBot
We're always improving SparkBot, so features, limits and the free plan may change. If we remove something significant from a paid plan, we'll tell you in advance.
9. Other sites and services
SparkBot works on pages run by other people and companies. We don't control them and aren't responsible for their content, availability or terms.
10. Our rights
SparkBot, including its software, design and brand, belongs to Hello Spark LLC and its licensors. These terms give you a personal, non-exclusive, non-transferable right to use it as intended, and nothing more. If you send us feedback or suggestions, we may use them without obligation to you.
11. Suspension and termination
You can stop using SparkBot at any time, and ask us to delete your account by emailing malcolm.felt@hellospark.ai. We may suspend or close your account if you break these terms, if your use creates risk or legal exposure for us or others, or if we stop offering SparkBot. Where we reasonably can, we'll give you notice first. Sections 4, 5 and 10 through 15 continue to apply after your account ends.
12. Disclaimers
SparkBot is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that SparkBot will be uninterrupted or error-free, or that its answers will be accurate or complete.
13. Limitation of liability
To the fullest extent the law allows, Hello Spark LLC won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from or related to SparkBot or these terms. Our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and $100. Some places don't allow these limits, so they may not all apply to you.
14. Indemnity
You'll defend and indemnify Hello Spark LLC against claims, losses and costs, including reasonable legal fees, arising from your content, your use of SparkBot, or your breach of these terms.
15. Governing law
These terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Utah, and you and we consent to their jurisdiction.
16. Changes to these terms
We may update these terms. When we do, we'll change the date at the top, and for significant changes we'll tell you by email or in the app before they take effect. If you keep using SparkBot after that, you accept the updated terms.
17. General
These terms and our Privacy Policy are the whole agreement between you and us about SparkBot. If any part is found unenforceable, the rest still applies. Not enforcing a part isn't a waiver of it. You can't transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets.
